Northern Ireland Water (NI Water) has launched a public consultation on its proposed Article 161 Sewer Bond Incentivisation and Surety Policy Framework.

The water company is seeking views on a proposed risk-based bond framework designed to support timely sewer adoption, protect customers and encourage responsible development across Northern Ireland.
The proposals aim to make sewer bond arrangements clearer, fairer and more proportionate, while helping to reduce the number of housing developments that remain unadopted for long periods.
The proposed approach would introduce a performance-based system for determining bond requirements. Developers with a strong record of compliance and timely adoption may benefit from reduced bond levels, while higher-risk developers may be required to provide stronger financial surety.
NI Water currently records approximately 600 development sites that have remained unadopted for more than five years. These cases can create uncertainty for homeowners, including difficulty selling or remortgaging properties, uncertainty over maintenance responsibility, and concerns about long-term repair costs and environmental risk.
The consultation forms part of NI Water's wider programme to reduce historic unadopted development numbers and move towards a more proactive adoption model. The aim is to provide greater confidence for customers, support responsible developers, and help enable sustainable housing delivery across Northern Ireland.
Key elements include:
- Risk-based tiering linked to developer performance and compliance.
- Proposed bond rates of 25%, 40% or 70% depending on assessed risk.
- Strengthened criteria for approved bond and surety providers.
- Clear governance, auditability and appeal arrangements.
NI Water is seeking feedback from homeowners, developers, construction professionals, housing bodies, councils, legal advisers, agents and anyone with an interest in sewer adoption and development infrastructure.
